Terms of service

1. Definitions

In these terms and conditions:

  • Entrepreneur: Anna Johanna, trading under the name www.annajohanna.nl.

  • Customer: any individual or legal entity entering into an agreement with the entrepreneur.

  • Products: all items offered by the entrepreneur, including standard items (made to order) and fully custom-made products.

  • Custom-made product: a product specifically made according to the customer's wishes, measurements or specifications, and not pre-manufactured.


2. Applicability

  1. These terms and conditions apply to every offer from the entrepreneur and to every agreement between entrepreneur and customer.

  2. Deviations are only valid if agreed upon in writing.


3. The Offer

  1. The offer includes a complete and accurate description of the offered products.

  2. Apparent mistakes or errors do not bind the entrepreneur.

  3. For custom-made items, a price estimate and detailed specifications are provided in advance.


4. The Agreement

  1. The agreement is concluded once the customer places an order and the entrepreneur confirms it in writing (e.g., via email).

  2. For custom orders, a deposit or full prepayment may be required, depending on the type of order (see article 7).

  3. The customer will receive an overview of the costs and expected delivery timeline.


5. Right of Withdrawal and Returns

  1. Standard made-to-order products:

    • Customers may return standard items within 14 days of receipt, provided they are unworn, undamaged, and with original tags.

    • Return shipping costs are at the customer's expense.

    • Orders are produced on order and typically require 2–5 business days to be made and shipped.

      Customers can submit their measurements or specifications through the provided form for a personal size check before the order is processed.

       

       

  2. Custom-made products:

    • The right of withdrawal does not apply to products made to customer specifications (Article 6:230p of the Dutch Civil Code).

    • Customers waive their right of withdrawal when placing a custom-made order and submitting the measurement form, where it is clearly stated that the right of withdrawal does not apply under these conditions.

    • Customized Order cancellations are permitted only on the same calendar day as the order placement, provided that the production process has not yet commenced.

6. Delivery and Risk

  1. The entrepreneur handles orders with the utmost care.

  2. Orders are shipped to the address provided by the customer.

  3. The risk of damage or loss is borne by the entrepreneur until delivery.


7. Pricing and Payment

  1. All prices are in euros, including VAT and excluding shipping costs unless stated otherwise.

  2. Products in the webshop must be paid for in full upfront via the available payment system. 

  3. Fully bespoke items (e.g., wedding dresses):

    • The customer will receive a quotation.

    • A 50% deposit is required upon confirmation.

    • Production begins only after the deposit is received.

    • The remaining balance must be paid before or upon delivery.

  4. The entrepreneur reserves the right to delay or cancel delivery in case of non-payment.


8. Liability

  1. The entrepreneur is not liable for damage resulting from improper use of the product.

  2. All products are handmade and/or created using deadstock materials. Minor variations in color, texture, or finish are inherent to the nature of handmade goods and the use of repurposed fabrics. These do not constitute grounds for complaints or liability.


9. Complaints

  1. Complaints must be submitted in writing within 7 days of receipt.

  2. The entrepreneur will respond within 14 days and aim to offer a suitable resolution.


10. Force Majeure

  1. The entrepreneur is not liable for delays or failures resulting from force majeure, including illness, material shortages, or transport disruptions.


11. Intellectual Property

  1. All designs, texts, and images on www.annajohanna.nl are the property of Anna Johanna and may not be used without permission.


12. Applicable Law

  1. All agreements are governed by Dutch law.

  2. Disputes will be resolved preferably in consultation. If necessary, they will be submitted to the competent court in the Netherlands.
